This website and service is provided by RockTLD. A UK based organisation.
By using our services, you agree to our terms and conditions, to be bound by them and to abide by them whilst using the services we provide and whilst accessing our website and associated applications.
Do not misuse our service, for example, do not interfere with our service or try to access them using a method other than the interface and the instructions that we provide. You may use our services only as permitted by law, including applicable local laws and regulations. We will suspend or stop providing our service to you if you do not comply with our terms or policies or if we have reason to suspect misconduct.
Using our service does not give you ownership of any intellectual property rights in our services or the content that you access. You may not use content from our service unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our service.
Our service displays mostly content that is not ours. This content is the sole responsibility of the member that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please do not assume that we do. It is your responsibility to ensure whatever you upload or display is done so in conjunction with our terms and policies. We accept no liability for any infringements.
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.
All visitors to the RockTLD website require a registered account in order to use our services.
If you learn of any unauthorised use of your password or account you must at first change your password if this is possible but in any event contact us without delay from your registered e-mail address using the contact us form.
We do not tolerate copyright infringement and terminate accounts of repeat offenders. To report any potential copyright infringement then contact us using the form available on the site where it will be investigated and dealt with promptly.
Our website allows “Artist” members to submit and upload content. You retain ownership of any Copyright and intellectual property rights that you hold in that content.
When you upload or otherwise submit content to our site, you give us a worldwide licence to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes that we make so that your content works better with our site), communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this licence are for the limited purpose of operating, promoting and improving our site, and to develop new ones. This licence continues even if you stop using our site.
We are constantly changing and improving our site. We may add or remove functionalities or features and we may suspend or stop a service altogether.
You can stop using our service at any time. We may also stop providing services to you or add or create new limits to our services at any time.
We believe that you own your data, and preserving your access to such data is important. If we discontinue a service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that service.
We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
We provide our services using a commercially reasonable level of skill and care and we hope that you will enjoy and benefit from using them. But there are certain things that we do not promise about our services.
Other than as expressly set out in these terms or additional terms, we do not make any specific promises about the services. For example, we do not make any commitments about the content within the services, any guaranteed benefits form using our services, the specific functions of the services or their reliability, availability or ability to meet your needs. We provide the services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
The materials contained on our site are provided for general information purposes only and do not claim to be or constitute legal or other professional advice and shall not be relied upon as such.
We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English law, we exclude all liability for loss or damages direct or indirect arising from use of this site.
When permitted by law we will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages.
To the extent permitted by law, the total liability of RockTLD for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use the services (or, if we choose, to supplying you with the services again).
In all cases, we will not be liable for any loss or damage that is not reasonably foreseeable
We recognise that in some countries, you might have legal rights as a consumer. If you are using the services for a personal purpose, then nothing in these terms or any additional terms limits any consumers’ legal rights which may not be waived by contract.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
We may modify these terms or any additional terms that apply to a service to reflect changes to the law or changes to our site or services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a service, you should discontinue your use of that service or our site.
If there is any inconsistency between these terms and the additional terms, the additional terms will prevail to the extent of the inconsistency.
These terms govern the relationship between RockTLD and you. They do not create any third party beneficiary rights.
If you do not comply with these terms and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site.
